Marcus McGowan Jr. was arrested and charged with two counts of Attempted Capital Murder, as well as Assault, Assault of a Public Servant, Resisting Arrest, Attempting to Take a Weapon From an Officer, Criminal Trespass, and Possession of a Controlled Substance.
On Monday evening, the Odessa Police Department arrested an 18-year-old man who allegedly broke into the newborn nursery at Odessa Regional Medical Center and assaulted two infants along with a group of medical staff trying to help the babies. Now an affidavit has revealed new details about the events that led to the arrest of Marcus McCowan Jr.
McCowan has been charged with two counts of Attempted Capital Murder, as well as Assault, Assault of a Public Servant, Resisting Arrest, Attempting to Take a Weapon From an Officer, Criminal Trespass, and Possession of a Controlled Substance.
According to the affidavit, around 6:30 p.m. on October 3, officers with the Odessa Police Department were called to ORMC, located at 520 E 6th Street after nurses called 911 and said a man was choking an infant. Officers arrived on the scene and, after a brief scuffle in which McCowan tried to resist, placed him in handcuffs. Investigators said as McCowan was being escorted away, he tried twice to take an officer’s gun from his holster but was unsuccessful.
Once McCowan was removed from the Labor and Delivery unit, investigators met with several nurses and a respiratory therapist who explained in detail what transpired.
McCowan was visiting the hospital because his girlfriend was in labor. According to one nurse, McCowan approached her at the nurse’s station and grabbed her arm and made an “unintelligible statement”. He was asked to leave the area and nurses said he then began running back and forth in the hall. The nurses called McCowan’s actions “odd and unreasonable”.
McCowan then reportedly approached a new mom who was holding her newborn in a baby carrier while waiting to be discharged. The nurses said McCown began focusing his attention on the newborn, but briefly walked away when the new mother moved her child from his line of sight. A short time later, nurses said they heard stomping and then saw McCowan running toward them at full speed while yelling and screaming.

The law was “triggered” when the U.S. Supreme Court issued its judgment in Dobbs v. Jackson, the case that overturned Roe v. Wade and allowed states to set their own laws about abortion.
Abortion clinics across Texas had already stopped performing the procedure, fearing prosecution under state laws that were on the books before Roe v. Wade.
Texas now has three significant abortion bans in place and several administrative regulations governing the procedure, setting up a potential conflict as the largest state to ban abortion navigates this new legal landscape.
The trigger law criminalizes performing an abortion from the moment of fertilization unless the pregnant patient is facing “a life-threatening physical condition aggravated by, caused by, or arising from a pregnancy.” The statute specifically prohibits prosecuting a pregnant patient who undergoes an abortion.
Violations of the law are punishable by up to life in prison. The statute also says that the attorney general “shall” seek a civil penalty of not less than $100,000, plus attorney’s fees.

💭 Officials have reported the first death of a person with monkeypox in Houston, Texas.
An adult in Texas may be the first reported monkeypox death in the United States, according to local health officials.
The unidentified person died in Harris County, the Texas Department of Health and Human Services announced Tuesday. No other details were provided.

At the time of their death, the person had monkeypox, officials said, and the “case is under investigation to determine what role monkeypox played in the death.”
“Monkeypox is a serious disease, particularly for those with weakened immune systems,” John Hellerstedt, the commissioner of the state’s Health Services Department, said in a statement. “We continue to urge people to seek treatment if they have been exposed to monkeypox or have symptoms consistent with the disease.”
A spokesman for the CDC confirmed to the Daily News on Tuesday that officials are “aware of a reported death.”
“Our thoughts are with the family during this heartbreaking time. It is important to remember that infections with the type of monkeypox virus identified in this outbreak — the Clade IIb — are fatal.
Monkeypox, a viral disease, spreads through “close, personal, often skin-to-skin contact,” according to the CDC. That includes, but is not restricted to, sexual intercourse.
Symptoms and signs include rash on the genitals, hands, feet, chest, face, or mouth that scabs before healing, fever, chills, swollen lymph nodes, exhaustion, muscle aches, headache and respiratory problems like a cough or nasal congestion.

A Texas suspects she was poisoned by touching a napkin stuffed in her car’s door handle outside a Houston restaurant. Doctors agreed she had been poisoned but were unable to identify the poisonous material.
Erin Mims joined her husband at a Houston-area restaurant to celebrate her birthday last Tuesday afternoon. As she left the restaurant she noticed someone stuck a napkin in the door handle on the passenger side of her car, Fox 26 Houston’s Sherman Desselle reported.
She pulled the napkin out of the door and opened it to get in the car. Once inside she asked her husband if he stuck the napkin in the door — he said no.
Mims decided to go back into the restaurant and wash her hands. A few minutes later, she began to feel a tingling sensation in her arm.
“Maybe five minutes, my whole arm started tingling and feeling numb. I couldn’t breathe,” Mims told the Fox 26 reporter. “I started getting hot flashes, my chest was hurting, my heart was beating really fast.”
Mim’s husband quickly took her to a hospital where doctors raced to determine what substance had been used to create the numbness and other symptoms her body experienced. Her vital signs jumped all over the place, she explained.
“The doctor came in, and told me it wasn’t enough in my system to determine what it was, but said it was acute poisoning from an unknown substance,” the woman said. He told her he thought it might have been an attempt to kidnap her.
Houston Police Department officials took an assault report but told Fox 26 they had not seen any kind of similar complaint before. An official with the Drug Enforcement Administration also said they had never heard of this type of attack.
Fox 26 consulted with poison control expert Mark Winter from the Southeast Houston Poison Center. He said her symptoms could match up to hundreds of different toxins. He called her exposure “casual” or minimal, the report explains.
Mims told Fox 26 she decided to share her story on social media and then her post went viral. She said several people said they had similar situations. Fox 26 said they were unable to confirm the reports.
“All I could do was think about my babies. It was the scariest moment of my life,” says Mims.

A young Venezuelan migrant family was left in limbo this week after being bussed to New York City from Texas — only to be told they were “ineligible” for shelter because they lacked proper documentation.
Dailin Rojas, who is 6 months pregnant, told The Post she was given the run-around after being told her family didn’t have the required documentation to allow them to stay at a homeless shelter in Jamaica, Queens.
Despite having stayed there for several weeks already, a distressed Rojas, her husband Johandre Merchan and their 3-year-old son were ordered to start the entire application process again.
“We were shocked. It’s not easy here,” the frustrated husband told The Post. “I was thinking a better life, better treatment, but it’s not easy.”
Rojas and her family are among a growing number of migrants forced to contend with shelter ineligibility because they can’t provide the documentation – such as past housing history or proof they are a family unit – that is usually required to be admitted to a city shelter.
Another two busloads of migrants arrived at Manhattan’s Port Authority Friday morning — adding to the hundreds that have been shipped off by Texas Gov. Greg Abbott as part of an ongoing political spat over President Biden’s border policies.
Mayor Eric Adams has previously insisted that all migrants would be welcome in the Big Apple — regardless if they have the correct documentation.
Gonzalez said the family’s plight was in direct contrast to Adams’ stance.
“What the mayor and the commissioner are saying is not true.” he told The Post.

“We just felt like it was a great opportunity to display our national motto in our public schools,” said TX Rep. Tom Oliverson of the Houston area.
The state of Texas just passed a new law that demands that schools must display donated posters that say “In God We Trust.” As we read in CNN:
Texas school districts have begun receiving donated posters and framed copies of the national motto, “In God We Trust,” that they will now be required to display in accordance with a new state law.
The law says a public elementary or secondary school or an institution of higher education “must” display a durable poster or framed copy of the motto in a “conspicuous place” in each building if the poster or framed copy is “donated for display at the school or institution” or “purchased from private donations and made available to the school or institution.”
State Sen. Bryan Hughes, a Republican co-author of the law, tweeted last week, “The national motto, In God We Trust, asserts our collective trust in a sovereign God.”
The people and organizations behind the donations have wasted no time in sending them out to schools.
The Carroll Independent School District in Southlake, a suburb of Dallas, on Monday received “In God We Trust” framed posters for each school in the district from Patriot Mobile, which describes itself as “America’s only Christian conservative wireless provider.”
Scott Coburn, the company’s chief marketing officer, told the school board, “Patriot Mobile is honored to donate these posters to CISD and we’re very excited to see them amongst all of our schools.”
The posters will be displayed in the front entrance areas of each Carroll ISD campus, Brandie Egan, the district’s communications coordinator, told CNN.
